Inheritance disputes: when a court case is unavoidable

Most inheritance cases at a notary's office go smoothly, but some situations — a missed deadline, dissatisfaction with a will, a dispute over shares between heirs — require going to court. The sooner this happens, the better the chances of keeping the right to inherit.

Missed the acceptance deadline — what to do

The deadline to accept an inheritance is 6 months from the decedent's death. It can be restored through court if there is a valid reason for missing it — for example, the heir did not know and could not have known about the inheritance, or was seriously ill.

When a will can be challenged

  • The will was drafted with a form violation — no notarization when it was required.
  • The decedent could not understand the meaning of their actions at the time of drafting.
  • The will was signed under deception, threats or violence.

Questions about inheritance

How much time is there to restore a missed deadline?
A court case must be filed within 6 months from when the reason for missing the deadline no longer applies — for example, when the heir learns the inheritance was opened.
Can a will be challenged after other heirs have already accepted the inheritance?
Yes, but the later a claim is filed, the harder it is to recover already-transferred property — act as early as possible.
Are heirs liable for the decedent's debts?
Yes, but only up to the value of the inheritance received — by law an heir is not required to pay more than they received.
From what moment does the deadline to enter into inheritance start counting?
From the date of the decedent's death - that date opens the inheritance and starts the 6-month clock to apply to a notary.
What documents will the notary need to process inheritance of property?
The title document for the property, a market value report as of the date of the decedent's death, and a certificate confirming no outstanding debts for utilities and taxes.
When can the certificate of the right to inheritance be received?
After 6 months from the decedent's death have passed and the state fee is paid - the certificate is not issued before that.
Can I still enter into inheritance if both possible deadlines were missed?
Formally that is very difficult, but every situation is different - at the consultation we will assess whether there are real grounds to restore the right through court.
Do I have to visit the notary in person?
No, you can act through a representative under a notarized power of attorney - especially useful for heirs living in another city.
